Welcome to Peach Lab Tampa! We are excited to have you as part of our community. These Terms and Conditions (“Terms”) are entered into by and between you and PEACH LAB TAMPA, LLC (“Peach Lab,” “we,” “us,” or “our”).
By purchasing a membership, class pack, or single class, and/or by attending classes, events, or other activities at our studio located in Tampa, Florida, you are agreeing to be bound by these Terms. Please read them carefully.
All new clients are required to sign a separate Liability Waiver before their first class.
Studio Policies & Code of Conduct
Peach Lab is a women-only fitness studio dedicated to creating a supportive, positive, and empowering environment. All members and guests are expected to contribute to this atmosphere.
First-Time Clients: Please arrive at least 10 minutes before your first scheduled class. This allows time for you to sign our waiver, get a studio orientation, and prepare for your class without rushing.
Studio Etiquette:
Please silence cell phones and store them with your personal belongings.
Clean all equipment thoroughly with the provided wipes after use.
Respect the instructors and fellow members. Disruptive, disrespectful, or unsafe behavior will not be tolerated.
Personal Belongings: Peach Lab Tampa is not responsible for any lost or stolen personal items. We recommend leaving valuables at home.
Minimum Age: You must be 18 years or older to attend classes at Peach Lab Tampa. Clients aged 16 or 17 may attend only if a parent or legal guardian signs the liability waiver in person on their behalf.
Class Booking, Cancellation, Lateness & Waitlist
Booking Policy
Classes can be booked up to [14] days in advance through our designated booking app or website.
All classes must be pre-paid.
Cancellation Policy
We adhere to a strict cancellation policy to ensure fairness to all members and our waitlisted clients.
Cancellation Window: You must cancel your class reservation at least [8] hours before the scheduled class start time. A cancellation made after this window is a “Late Cancel.”
Late Cancel Penalty (Class Pack Members): If you late cancel, you will forfeit the class credit used to book the class.
Late Cancel Penalty (Unlimited Members): If you late cancel, you will be charged a [$15] late-cancellation fee.
No-Show Policy
A “No-Show” occurs if you do not show up for a class you are registered for and do not cancel.
No-Show Penalty (Class Pack Members): If you no-show, you will forfeit the class credit used to book the class.
No-Show Penalty (Unlimited Members): If you no-show, you will be charged a [$25] no-show fee.
All cancellation and no-show fees are charged automatically to the credit card on file.
Lateness Policy
We have a [5-minute] lateness policy.
If you are more than 5 minutes late to a class, your spot may be given to a waitlisted member.
If your spot is given away, you will be considered a “No-Show” and the penalty will apply. This policy is for your safety and to prevent disruption to the class.
Waitlist Policy
If a class is full, you can join the waitlist.
If a spot opens up, you will be automatically added to the class (up to [2] hours before class time) and will receive an email confirmation.
If you are added from the waitlist, you are subject to the same cancellation policy. Please remove yourself from the waitlist if you no longer wish to attend.
Memberships, Class Packs & Purchases
Purchase & Refund Policy
All sales are final. All purchases for memberships, class packs, personal training, and retail are non-refundable and non-transferable.
We reserve the right to change our pricing and fees at any time.
Class Packs
Class packs (e.g., 10-Packs) expire [12] months from the date of purchase.
Class packs cannot be shared between clients.
Monthly Memberships
All monthly memberships (e.g., “Unlimited,” “Credit”) are recurring and will auto-renew each month on your billing date.
Failed payments will incur a [$25] late fee if not rectified within [3] days.
Membership Cancellation
To cancel your recurring monthly membership, you must provide written notice via email to [your studio email address] at least [30] days before your next billing date.
You will be responsible for one final payment, which will be charged on your regular billing date following your notice.
If your membership has a minimum commitment (e.g., 3 months), you are responsible for all payments within that term.
Membership Freeze (Pause) Policy
Members may request to freeze their membership one (1) time per calendar year for a minimum of [14] days and a maximum of [60] days.
A written freeze request must be submitted via email at least [7] days before the start of the freeze.
Medical freezes are an exception and can be accommodated with a valid doctor’s note, without counting as the annual freeze.
Personal Training
We require 24-hour notice to cancel or reschedule a 1:1 Personal Training session. If you cancel or no-show within this 24-hour window, you will be charged the full price of the session.
Health & Safety
Your health and safety are our top priority.
Liability Waiver: All new clients must read, understand, and sign a Liability Waiver before participating in any class or activity at Peach Lab Tampa.
Health Attestation: You agree that you are in good physical condition and have no medical impairment that would prevent you from participating in our classes. It is your responsibility to consult with a physician before starting any new fitness program.
Inform Instructors: You must inform your instructor of any injuries, medical conditions, or pregnancy before class begins so they can offer appropriate modifications. You agree to participate at your own risk.
Right to Refuse Service: Peach Lab Tampa reserves the right to refuse service, or ask a member to leave the premises, for any behavior that is disruptive, unsafe, or violates our studio policies.
Media Release
We often take photographs and videos in our studio for use in marketing, advertising, and on our social media platforms (e.g., Instagram, website). By attending classes at Peach Lab Tampa, you consent to your likeness (photo and video) being used for these purposes without compensation.
Opt-Out: If you do not wish to be photographed or filmed, please notify us in writing via email at [email protected].
Consent to Communications (Email & Text)
When you create an account, make a purchase, or otherwise provide your contact information to us (such as through a “Contact Us” or “Join Now” form), you expressly consent to receive communications from Peach Lab Tampa.
Emails: You agree to receive promotional and informational emails, such as newsletters, special offers, and studio updates. You may opt-out at any time by clicking the “Unsubscribe” link at the bottom of any email.
Text Messages (SMS/MMS): You agree to receive promotional and transactional text messages (such as class reminders, waitlist notifications, and marketing alerts) from us to the phone number you provide. You understand that your consent is not a condition of purchase. Message and data rates may apply. You may opt-out of marketing texts at any time by replying “STOP” to any message. For help, reply “HELP”.
Your agreement to these Terms and Conditions and your use of our services serves as your explicit written consent to these communications and is also governed by our Privacy Policy.
Intellectual Property Rights
All content on this website (peachlabtampa.com), including but not limited to text, graphics, logos, images, class names, videos, branding, and the “look and feel” of the site, is the exclusive property of PEACH LAB TAMPA, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on this site without our express written permission.
Website Use and Prohibited Conduct
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our website for your personal, non-commercial use. You agree not to:
Use the site for any illegal or unauthorized purpose;
Engage in any data mining, scraping, or use of bots or similar data gathering/extraction methods;
Interfere with the security or proper functioning of the site;
Use any content, including our trademarks or class names, for any purpose not expressly permitted.
Third-Party Links
Our website may contain links to third-party websites or services, such as our booking provider (Mariana Tek) or social media platforms. We do not own or control these third-party sites and are not responsible for their content, privacy policies, or practices. You access these links at your own risk.
Disclaimer of Warranties; Limitation of Liability
The website and all services are provided “as is” and “as available” without any warranties, express or implied.
PEACH LAB TAMPA, LLC (including its owners, employees, agents, and marketing agency) does not warrant that the website will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, PEACH LAB TAMPA, LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of (or inability to use) the website or any of its services.
Indemnification
You agree to indemnify, defend, and hold harmless PEACH LAB TAMPA, LLC and its affiliates, officers, directors, employees, agents, and instructors from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) that arise from your participation in classes, your use of the studio or website, or your violation of these Terms.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida.
Changes to These Terms
We reserve the right to modify or update these Terms and Conditions at any time. We will post the most current version on this page with an updated “Last Updated” date. Your continued use of our services or website after any changes constitutes your acceptance of the new Terms.
